The Constitutional Court (TC) of Peru declared unconstitutional the "express" dismissal processes applied by the previous National Board of Justice (JNJ) during the administration of Martín Vizcarra. With this decision, several magistrates who had been removed from their positions will be reinstated, including the Attorney General of the Nation, Patricia Benavides.
The TC resolution argues that the dismissals were carried out without due process, violating the right to defense of the affected magistrates. The National Board of Justice, under the management of Vizcarra, had implemented these dismissals with the aim of "purifying" the judicial system, but its actions were questioned by various sectors that denounced irregularities and political motivations.
The return of Patricia Benavides and other judges could have a significant impact on key court cases and the stability of the Peruvian judicial system. Some analysts predict a confrontation between the TC and other state agencies that supported the removals.
