STF suspends breach of confidentiality of businesswoman investigated by the INSS Parliamentary Commission of Inquiry, setting a possible precedent for other targets.

  • Minister Flávio Dino, of the Supreme Federal Court (STF), granted a preliminary injunction this Wednesday suspending the breach of bank and tax secrecy of businesswoman Roberta Moreira Luchsinger, approved by the Joint Parliamentary Commission of Inquiry. The decision comes in response to a writ of mandamus filed by the defense of the businesswoman Luchsinger, who alleged irregularities in the procedure adopted by the commission.

  • The INSS Parliamentary Commission of Inquiry (CPMI), established to investigate alleged fraud in undue deductions from the pensions and retirement benefits of beneficiaries, approved on February 26 a series of requests for the lifting of confidentiality, including those of Luchsinger and her company, RL Consultoria e Intermediações Ltda. These requests covered the period from January 1, 2019 to December 31, 2025 and were deliberated as a block, along with 86 other similar items, without individualized analysis. In his decision, Dino argued that the power of parliamentary commissions of inquiry does not allow for an "indiscriminate invasion of the private lives of citizens" and that specific justification is essential for each invasive measure, such as the lifting of confidentiality. The minister criticized the "global" vote, stating that it violates due process and constitutional rights.

  • He authorized, however, that the Joint Parliamentary Inquiry Commission (CPMI) hold a new deliberation, provided that it observes the formal procedure with individualized justifications for each request. Roberta Moreira Luchsinger is identified as a close friend of Fábio Luís Lula da Silva, known as Lulinha, son of President Luiz Inácio Lula da Silva. Although Dino's decision does not expressly mention Lulinha—whose confidentiality was also breached in the same CPMI session—legal analysts believe that the precedent set could be exploited by the defense of other investigated parties to contest the measures approved collectively. Lawyers consulted indicate that similar appeals could be filed with the Supreme Federal Court (STF), potentially impacting the progress of the investigations.

  • The INSS CPMI focuses on investigating irregularities in payroll loans and fraudulent loans affecting millions of retirees and pensioners. Among the targets are companies suspected of illegal intermediation and figures linked to financial schemes. The suspension of the breach of confidentiality regarding Luchsinger represents a setback for the commission, which will now need to review its procedures to avoid further legal challenges. The full Supreme Court will still have to ratify Dino's injunction in a future session.

  • So far, the Presidency of the Republic and the Presidential Palace have not commented on the case. Representatives of the Joint Parliamentary Inquiry Commission, in turn, stated that they will evaluate the next steps to ensure the continuation of the investigations within constitutional limits. The episode reinforces the debate about the limits of parliamentary commissions and the protection of individual rights, in a context of increasing judicialization of inquiries in the National Congress.
